It works by channel: phone, <a href=\"https:\/\/mailrelay.com\/en\/glossary\/correo-postal\/\">postal mail<\/a>, email and <a href=\"https:\/\/mailrelay.com\/en\/glossary\/sms-marketing\/\">SMS<\/a> or MMS.<\/p>\n\n<p class=\"wp-block-paragraph\">In Spain, it is managed by the Spanish Digital Economy Association (Adigital). It is an &#8220;advertising opt-out system&#8221;, as the law calls it, and companies that advertise without consent must check it before every campaign.<\/p>\n\n<p class=\"wp-block-paragraph\">The name comes from Robinson Crusoe: people who sign up want to stay &#8220;isolated&#8221; from advertising they didn&#8217;t ask for.<\/p>\n\n<h2 class=\"wp-block-heading\">What is the Robinson List and what is it for?<\/h2>\n\n<p class=\"wp-block-paragraph\">It is a shared register of people who don&#8217;t want to receive commercial communications. It serves two purposes:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>For consumers:<\/strong> to tell all companies, just once, that they don&#8217;t want advertising through a specific channel.<\/li>\n\n\n\n<li><strong>For companies:<\/strong> to know who they must not send advertising to when they don&#8217;t have their consent.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">It doesn&#8217;t replace other rights. If you want to stop receiving emails from a specific company, you can still use the <a href=\"https:\/\/mailrelay.com\/en\/glossary\/unsubscribe\/\">unsubscribe link<\/a> in its messages or exercise your right to object with that company.<\/p>\n\n<h2 class=\"wp-block-heading\">How to sign up for the Robinson List<\/h2>\n\n<ol class=\"wp-block-list\">\n<li>Go to the official website, listarobinson.es, and register for free with your details.<\/li>\n\n\n\n<li>Choose the channels through which you don&#8217;t want to receive advertising: phone, postal mail, email or SMS\/MMS.<\/li>\n\n\n\n<li>If you want to keep receiving advertising from a particular company, add it as an exception.<\/li>\n<\/ol>\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.aepd.es\/prensa-y-comunicacion\/blog\/tengo-derecho-no-recibir-publicidad-que-es-la-lista-robinson\">According to the AEPD<\/a>, your registration takes effect within three months. It doesn&#8217;t stop:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Advertising you have authorized.<\/strong> If you gave your <a href=\"https:\/\/mailrelay.com\/en\/glossary\/double-opt-in\/\">consent<\/a> to a company, it can keep writing to you even if you&#8217;re on the list. To stop receiving it, you have to object to that company.<\/li>\n\n\n\n<li><strong>Messages that aren&#8217;t advertising.<\/strong> An invoice, a shipping notice or a change to the terms of your contract are not commercial communications.<\/li>\n\n\n\n<li><strong>Those who break the law.<\/strong> <a href=\"https:\/\/mailrelay.com\/en\/glossary\/spam\/\">Spam<\/a> senders and fraudulent callers don&#8217;t check the list. If this happens to you, you can file a complaint with the AEPD.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">Robinson List for companies: when you need to check it<\/h2>\n\n<p class=\"wp-block-paragraph\">Article 23 of Spain&#8217;s <a href=\"https:\/\/mailrelay.com\/en\/glossary\/lopd-organic-law-data-protection\/\">Organic Law on Data Protection<\/a> (LOPDGDD) requires anyone who wants to send direct advertising <strong>without the consent<\/strong> of the recipients to check the advertising opt-out systems. Spain&#8217;s Information Society Services Act (<a href=\"https:\/\/mailrelay.com\/en\/blog\/2016\/02\/23\/email-marketing-compliance-rules-for-a-legal-campaign\/\">LSSI<\/a>, article 21) prohibits sending advertising by email or SMS without prior consent. The exception is your customers, if you offer them products similar to those they have already bought from you and they can easily unsubscribe.<\/p>\n\n<p class=\"wp-block-paragraph\">That&#8217;s why, if you build your list with permission, the Robinson List hardly ever affects you when it comes to email. Where it matters most is in phone calls and postal mail.<\/p>\n\n<h3 class=\"wp-block-heading\">What about phone calls?<\/h3>\n\n<p class=\"wp-block-paragraph\">Since June 29, 2023, Spain&#8217;s General Telecommunications Law 11\/2022 requires prior consent to make commercial calls, with some exceptions. The AEPD developed this in its <a href=\"https:\/\/www.aepd.es\/prensa-y-comunicacion\/notas-de-prensa\/la-aepd-publica-la-circular-sobre-el-derecho-de-los-usuarios\">Circular 1\/2023<\/a>.<\/p>\n\n<p class=\"wp-block-paragraph\"><em>This entry is general information, not legal advice.
